أكدت وزارة الموارد البشرية والتنمية الاجتماعية لـ«عكاظ»، أن تصنيف بعض التصرفات فساداً إدارياً من صلاحيات جهات الاختصاص؛ وهي المسؤولة عن تقييم تلك الحالات وتحديد مدى انطباق توصيف الفساد عليها، مؤكدة التزامها بدعم العدالة الوظيفية وحقوق العاملين. وشددت الوزارة على أهمية تحديد المهمات الوظيفية للموظفين واعتمادها ضمن عقود العمل، وأن النظام يلزم أصحاب العمل والعاملين بالاتفاق على طبيعة المهمات في العقود مع الالتزام بأحكام اللائحة التنظيمية للمنشآت.
وأوضحت الوزارة في تصريحها لـ«عكاظ»، أن عقود العمل تُحرر وفق النموذج الموحد المعد منها، ويشتمل على بيانات الموظف، وصاحب العمل، ونوع ومكان العمل. وأشارت إلى أن توقيع المدير على التكليفات الوظيفية يعد جزءًا من الالتزامات النظامية، وفي حال عدم الالتزام بها يُعتبر ذلك مخالفة يتم تقييمها من قبل الجهات المختصة.
وأشارت، إلى أن نظام العمل، ولائحته التنفيذية الصادرة في 11/ 4/ 1440هـ، يضمنان حقوق العاملين، ويوفران لهم الحماية القانونية عند تعرضهم لقرارات تتعارض مع أحكام النظام. وللعامل الحق في الاعتراض على أي قرار يصدر بحقه، بما في ذلك القرارات المتعلقة بتغيير مهمات العمل المتفق عليها، من خلال تقديم اعتراض لدى المحاكم العمالية.
