Donald Trump is the first president-elect in U.S. history to win an election while awaiting sentencing on 34 criminal counts.
It remains to be seen what type of sentence Justice Juan Merchan will impose if the sentencing goes ahead as scheduled in late November. Meanwhile, special counsel Jack Smith’s two federal cases against Trump were doomed when Trump defeated Vice President Kamala Harris on Election Night 2024. And Fulton County, Georgia District Attorney Fani Willis’ election interference/RICO case against Trump and a long list of allies remains in limbo.
During a Thursday, November 7 broadcast of Fox News’ “The Five,” two of the hosts — Greg Gutfield and Dana Perino — called for “the death penalty” for Trump’s prosecutors.

Gutfield mockingly told his colleagues, “A lot of the people that were on this and wanted it so badly, how are they going to survive? Do you think they need therapy?”
Perino responded, “Yes, they definitely need therapy, and maybe also the death penalty.”
Gutfield agreed, saying, “Yes, I think the death penalty.”
Some legal experts are recommending that Smith write final reports on both of his cases against Trump, putting them to rest before Trump’s inauguration on January 20, 2025.

The Daily Beast’s Grace Harrington points out that Trump, as president, will have the ability to parson federal charges but not charges at the state level.
“There are currently ongoing state cases against him in New York, for giving hush money to a porn star, and in Georgia for election interference,” Harrington notes. “Trump cannot pardon himself for state crimes. Fulton County District Attorney Fani Willis, who is prosecuting Trump’s case in Georgia, just won reelection.”
