Femi Falana (SAN), a prominent human rights activist and lawyer, has recently voiced his opposition to the claim made by Dr Olisa Agbakoba (SAN) regarding the legality of the Economic and Financial Crimes Commission (EFCC). In a letter addressed to the President of the Senate and the Speaker of the House of Representatives, Falana disagreed with Agbakoba’s assertion that the EFCC is an “unlawful organization.”
Falana pointed out that Agbakoba did not provide any substantial evidence to support his claim that the Supreme Court has criticized the EFCC, highlighting that the Supreme Court has consistently supported the efforts of both the EFCC and the ICPC in combating corruption.
He also referenced a past case where the Supreme Court upheld the constitutional validity of the ICPC Act, emphasizing that the EFCC plays a vital role in combating economic and financial crimes at both the federal and state levels.
Falana urged the National Assembly to use the ongoing constitutional review to solidify the legal standing of the EFCC and the ICPC by incorporating them into the Constitution, thereby ensuring their effectiveness in fighting corruption.
