The Potential for Trade Measures Against Israel Following ICJ Advisory Opinion
Taoiseach Simon Harris has announced that the Attorney General will provide advice to the Government next week concerning the International Court of Justice’s recent advisory opinion on Israel’s occupation of Palestinian territories. The ICJ found Israel’s settlement policies and exploitation of natural resources in breach of international law, prompting calls for countries to review interactions with Israel.
Mr. Harris noted that while trade is an EU competence, the Government will consider potential unilateral measures against Israel based on the Attorney General’s advice. He emphasized the importance of ending the illegal occupation and implementing the ICJ opinion.
Despite the need for legal advice on trade measures, Ireland and Spain have raised concerns about the EU-Israel Association Agreement and called for a review. However, achieving consensus among EU member states on this matter remains a challenge, requiring a unanimous decision by all capitals.
The ICJ advisory opinion has been described as a “game changer” by the Irish Government, sparking discussions on potential trade restrictions to support ending the unlawful occupation of Palestinian territories.
