IHC instructs CDA to unseal KP House in Pakistan.

Islamabad High Court Orders De-Sealing of Khyber Pakhtunkhwa House

The Islamabad High Court (IHC) has directed the capital’s administration to de-seal the Khyber Pakhtunkhwa House, which was sealed by the Capital Development Authority (CDA) for allegedly violating building rules. The building was at the center of a recent controversy involving KP Chief Minister Ali Amin Gandapur and law enforcement agencies. Gandapur had sought refuge in the building after leading a protest in Islamabad.

The court ruled that the CDA’s action was without legal authority as no valid notice was issued before sealing the building. The CDA claimed the premises had multiple lease breaches, including unlawful construction and unpaid dues, but failed to produce copies of the notices served to KP House officials. The court instructed the CDA to immediately de-seal the property but allowed for legal action if lease violations were found.

The ruling highlights the importance of due process in such cases and ensures that proper procedures are followed in dealing with lease violations. The decision brings relief to the provincial government and sets a precedent for future actions against similar allegations.
