JSC grills Judge Chetty for MKP/ANC trademark ruling

During a recent commission interview, commissioner advocate Tembeka Ngcukaitobi challenged a nominee, highlighting the importance of engaging and not avoiding questions. The discussion centered around the “first user” principle, suggesting that trademark infringement could occur even without registration. While the matter was not argued on this basis, the point raised was acknowledged.

Despite facing some criticism, nominee Chetty received support from Prof Clement Marumoagae of Wits Law School. Chetty, a candidate for judicial vacancies, has a decade of experience on the bench and a background in public interest litigation. The interviews are ongoing, but the absence of impeached judge John Hlophe has caused disruptions.
