The High Court in Co Kerry has overturned An Bord Pleanála’s decision to refuse permission for the proposed gas terminal by Shannon LNG. The company plans to build a power plant, battery energy storage system, and re-gasification unit on a 630-acre site between Tarbert and Ballylongford.
An Bord Pleanála had initially denied permission due to concerns about energy supply but the High Court ruled that the decision was not based on a formal State directive. The court also found that An Bord Pleanála failed to consider support for the project in various county and national development plans.
The ruling by Mr. Justice Richard Humphreys allows for the project to be resubmitted for review by An Bord Pleanála after almost 17 years since the project was first proposed. The decision highlights the importance of proper consideration of all relevant policies and supports in planning decisions.
