The Supreme Court declared Luqman Ali Afzal, owner of the Monal Group of Companies, as a trespasser with no legal right to the land in Margalla Hills National Park. Chief Justice of Pakistan noted that La Montana and Gloria Jeans were violating wildlife ordinances. The court rejected review petitions by various parties, directing the Wildlife Management Board to take possession of the restaurants. The judgement criticized the operators for damaging the park’s integrity, flora, and wildlife. It highlighted the environmental cost and lack of adherence to laws.
The Supreme Court also admonished the Monal group for attempting to retract an undertaking and emphasized the consequences of such actions. The review also found Sunshine Heights’ allotment in violation of the law, with no construction in 28 years. The court deemed the presence of La Montana and Gloria Jeans illegal, facilitated by powerful individuals. The judgement censured the defence ministry’s legal advisor for non-compliance and disloyalty.
