The Supreme Court recently upheld the 2017 decision for the repatriation of Class III and IV employees of Andhra Pradesh State Road Transport Corporation to their parental zones in Telangana. This decision comes following the 2014 bifurcation of unified Andhra Pradesh. The bench of Justices P S Narasimha and Pankaj Mithal allowed an appeal filed by APSRTC against the high court’s 2019 judgment, directing for the permanent allocation of employees to their deputational posts in Andhra Pradesh.
The employees were recruited at the regional level and belong to the successor state corporation where their region falls. The court emphasized the statutory mandate and guidelines on employee allocation. The Board of Directors had decided in 2017 that Class III and IV employees are to be allocated to the corporation of their region after bifurcation.
The High Court’s division bench failed to acknowledge important provisions and the employees have returned to their parent cadre in Telangana. The employees did not challenge the guidelines on employee allocations but questioned the notification on repatriation. This decision stands as a significant outcome of the long-standing issue post the bifurcation of Andhra Pradesh.
