Legislation to provide welfare measures for gig workers is gaining momentum in various states across India. Rajasthan has already implemented the Rajasthan Platform-Based Gig Workers (Registration and Welfare) Act, 2023, which includes a worker welfare fee on aggregators. Similarly, Jharkhand has proposed the Jharkhand Platform Based Gig Workers (Registration and Welfare) Bill, 2024, that imposes a gig workers welfare fee on aggregators.
This trend is not new, as other state and central legislations have previously used the earmarking model for labor welfare. Examples include the Limestone and Dolomite Mines Labour Welfare Fund Act, 1972, and the Iron Ore Mines Labour Welfare Cess Act, 1961, at the central level, and the Kerala Coir Workers’ Welfare Fund Act, 1987, at the state level.
These measures aim to ensure the welfare of gig workers, who often lack traditional employment benefits. By imposing fees on aggregators, the government is taking steps to protect the rights and well-being of workers in the gig economy.
