A recent lawsuit filed in Wake County Superior Court argues that the decision made by North Carolina’s board of elections to deny Robert F. Kennedy Jr.’s request to remove his name from the ballot is a violation of his free speech rights. The lawsuit claims that the board’s refusal to acknowledge Kennedy’s statutory rights has irreparably harmed him and compelled speech against his will. Despite the board’s rationale that it would be impractical to remove him from the ballot due to already printed ballots, the lawsuit maintains that this issue is of the board’s own making.
With North Carolina’s election board having a Democratic majority, the vote to deny Kennedy’s request was split along party lines. Michigan and Wisconsin have also denied Kennedy’s request to be removed from their ballots. Recent polling data shows a tight race in North Carolina between Donald Trump and Vice President Kamala Harris; however, adding Kennedy’s name to the ballot shifts support away from Trump. Kennedy had suspended his campaign and endorsed Trump in August, intending to stay on non-competitive state ballots.
