After months of activism, 10 states will feature constitutional amendments regarding abortion rights on their upcoming general election ballots. Swing states like Arizona and Nevada, along with blue-leaning states such as Colorado, Maryland, and New York, and red-leaning states including Florida, Missouri, Montana, Nebraska, and South Dakota, will allow voters to directly influence the future of abortion access.
These amendments aim to solidify or expand abortion rights following the Supreme Court’s overturn of Roe v. Wade in 2022. If passed, the proposed amendments would have significant impacts on current abortion care laws in each state.
For example, in Arizona, the amendment would establish a “fundamental right” to an abortion up to fetal viability. In Colorado, it would recognize the right to abortion and prevent government interference. Other states like Florida, Missouri, Montana, Nebraska, Nevada, New York, and South Dakota also have specific provisions in their proposed amendments to protect or regulate abortion access.
