A high-stakes legal battle is unfolding in Arizona as Judge Bruce Cohen weighs the fate of 18 defendants, including Rudy Giuliani and other Donald Trump allies, accused of participating in a scheme to alter the outcome of the 2020 election. The defendants, known as “fake electors,” face charges of fraud, forgery, and conspiracy for falsely claiming to represent Arizona’s Electoral College.

While the defendants argue they were exercising their First Amendment rights, prosecutors contend the charges are related to criminal activity, not political speech. Two defendants have already struck plea deals, but others are challenging the prosecution under Arizona’s anti-SLAPP law.
