Despite the case being dismissed by a federal judge appointed by Trump, Smith, appointed by President Biden’s attorney general, is challenging the decision in the appeals court. Smith argues that special-counsel appointments are well-established and endorsed by Congress.
Facing charges of willful retention of national defense information, conspiracy to obstruct justice, and making false statements, Trump, 78, is navigating multiple legal battles while eyeing a return to the White House.
