The Supreme Court has agreed to hear the case of Patna High Court judge Justice Rudra Praksah Mishra, who has not received his salary for 10 months due to not having a General Provident Fund (GPF) account. The issue revolves around pension and pay for serving and former high court judges.
A bench led by Chief Justice D Y Chandrachud decided to prioritize the case after Mishra’s counsel raised the matter. The judge’s salary has been withheld by the Bihar government claiming a new pension scheme.
Justice Mishra was appointed to the high court from the district judiciary and is seeking intervention for the opening of a GPF account and salary release. The plea also requests a declaration stating Mishra’s entitlement to subscribe to GPF accounts under the High Court Judges Act of 1954.
The hearing, set for Friday, aims to address the discrepancies in pension schemes for judicial officers, striving for equality among judges in the same cadre.
