An ex-officio lawyer from Bihac was fined for not appearing at the hearing before the Court of Bosnia and Herzegovina (BiH), which he justified by the Chamber’s decision to go on strike, which is mandatory for all lawyers if they do not want to face disciplinary sanctions. While in institutions they consider strikes illegal, lawyers consider punishing colleagues inhumane.
Defense attorney Edin Felic was fined 1,000 BAM for missing a hearing for his client’s war crimes case in Bosanska Krupa. Despite informing the court of his inability to attend due to a lawyer strike, his absence was deemed unjustified by the judge.
According to the Law on Criminal Procedure of BiH, a defense attorney can be fined up to 5,000 BAM for not responding to a court summons without justification.
President of the Bar Association of the Federation, Bekir Gavrankapetanovic, emphasized the seriousness of disobeying decisions during strikes, highlighting the disciplinary consequences for lawyers.
