A coalition of Republican states is taking legal action against the Biden administration to prevent certain illegal immigrants from becoming eligible for Obamacare, just before the 2024 presidential election. The rule, set to go into effect in November, would extend healthcare access through the Affordable Care Act to illegal immigrants protected under the DACA program, prompting concerns about violations of federal law.
Led by Kansas Attorney General Kris Kobach, fifteen states argue that the plan contradicts existing laws that prohibit benefits for illegal immigrants. The lawsuit challenges the new regulation that aims to redefine “lawfully present” individuals under the ACA to include DACA recipients.
The administration’s move has sparked debate among political leaders, with President Biden and Vice President Harris voicing their support for Dreamers and advocating for permanent solutions through congressional action.
