Supreme Court to Hear Final Pleas Against Allahabad HC Order Scrapping UP Madarsa Education Act

Supreme Court to List Final Hearing on Plea Challenging Scrapping of Madarsa Board Act

The Supreme Court has scheduled the final hearing for the pleas challenging the Allahabad High Court’s decision to scrap the Uttar Pradesh Board of Madarsa Education Act, 2004, deeming it “unconstitutional” and against secularism. The top court had previously stayed the high court ruling, citing the need for further review.

A bench comprising Chief Justice D Y Chandrachud and justices JB Pardiwala and Manoj Misra has set August 13 as the date for the final disposal of the pleas. The court has also appointed lawyer Ruchira Goel as the nodal counsel for ensuring the filing of necessary documents.

The high court’s decision to relocate students from madrasas was critiqued by the apex court, which noted its impact on around 17 lakh students. The state government has accepted the judgement but argued against bearing the financial burden of the legislation.

The high court’s ruling on the Madarsa Act, 2004, was based on the violation of secular principles. The petitioner had questioned the constitutionality of the Madarsa Board and the management by the Minority Welfare Department instead of the education department.
