High Court to send nitrates challenge to European court

The High Court to Refer An Taisce Challenge to European Court of Justice

The High Court has made a significant decision to refer An Taisce’s challenge of the Government’s fifth Nitrates Action Programme to the European Court of Justice. In a judgment, Mr Justice Humphreys stated that the case raises novel and complex issues of EU law, warranting further consideration by the European court.

An Taisce’s challenge revolves around the Nitrates Action Programme allowing Irish farmers higher levels of organic nitrates on their land, which the organization claims is not adequately protecting waterways. An Taisce CEO Gary Freemantle welcomed the judgment, stating it is a step towards safeguarding Ireland’s waterways for future generations.

The President of the Irish Creamery Milk Suppliers Association (ICMSA), Denis Drennan, supported the decision, emphasizing the importance of retaining the Nitrates Derogation for Irish farming. ICMSA submitted substantial evidence in the case and is pleased with the court’s consideration of farmer concerns.

The timeline for the European Court of Justice’s consideration of the referral remains uncertain. However, this development marks a crucial step in ensuring environmental protection and sustainability in Ireland.
