High Court to send nitrates challenge to EU Court

The High Court has decided to refer An Taisce’s challenge of the Government’s Nitrates Action Programme to the European Court of Justice. Mr Justice Humphreys stated that the issues raised by An Taisce are novel, complex, and important in EU law. An Taisce argues that the programme allowing increased levels of organic nitrates on Irish farmland does not protect water as intended.

CEO Gary Freemantle expressed that this judgment is a step towards safeguarding Ireland’s waterways, aligning with An Taisce’s mission to protect the environment. ICMSA President Denis Drennan welcomed the decision, emphasizing the importance of the Nitrates Derogation for Irish farming.
