AfriForum, a civil rights organisation, has taken legal action against the appointment of former Western Cape judge president John Hlophe to the Judicial Service Commission (JSC). Despite being impeached for gross misconduct, Hlophe was appointed as one of six MPs to serve on the JSC by the National Assembly.
AfriForum CEO Kallie Kriel emphasized that Hlophe’s appointment is irrational, unlawful, and conflicts with the National Assembly’s constitutional duty. The organisation has lodged an application to the Constitutional Court to challenge this appointment, citing concerns about Hlophe’s ethics and integrity.
Kriel highlighted that Hlophe’s presence on the JSC undermines the credibility and independence of the judiciary, as well as the rule of law. The DA, FF Plus, and ACDP opposed his appointment, while the ANC, MKP, EFF, and others supported it, arguing that Hlophe qualifies as an MP.
In the past, Hlophe was impeached for attempting to influence Constitutional Court judges in a corruption case involving former president Zuma. AfriForum’s legal action aims to uphold the integrity of the judiciary and ensure public trust in the judicial system.
