Panel proposes lifting broadcast moratorium

The Electoral Commission has recommended the removal of the broadcast moratorium covering referendum issues before the next electoral event. This moratorium prohibits television and radio broadcasters from reporting on elections or referendums from 2pm on the day before the polls open until after they are closed. The Commission also suggests that the Government should publish any proposed constitutional amendments at least 16 weeks before the proposed polling day, with a minimum of 60 days’ notice of the polling day. They also recommend a review of the design of referendum ballot papers.

An Coimisiún Toghcháin, established in 2023 to provide neutral explanations of referendum proposals, emphasizes the importance of public engagement and turnout. During the Family and Care referendums in March, they distributed 2.3 million information booklets and conducted an advertising campaign to encourage voter participation.

Art O’Leary, Chief Executive of An Coimisiún Toghcháin, highlighted the need for improvements in the referendum process, including campaign timings, broadcast moratorium, and ballot paper design, for a better voter experience in constitutional votes.
