Challenging Government Authority: PBC Members Petition Against ISI Call Interception

Six Pakistan Bar Council (PBC) members have taken a stand against the federal government’s decision to authorize the Inter-Services Intelligence (ISI) to intercept calls and messages. The Islamabad High Court (IHC) has admitted their petition for regular hearing, arguing that the July 8, 2024 notification is unconstitutional and violates existing laws.

The petitioners highlighted the lack of proper legal framework for call interception and emphasized the importance of following due process as outlined in the Fair Trial Act, 2013. In response, the court has requested a report from the authorities and postponed further proceedings.

Simultaneously, a similar case has been brought before the Lahore High Court (LHC) by retired major Ghulam Sarwar, questioning the invasion of privacy caused by the government’s actions. Justice Farooq Haider has recommended a larger bench to address the important legal issues raised in the petition.
