In 2015, Germany’s Federal Constitutional Court rejected a general headscarf ban for teachers, citing it as a violation of religious freedom. Fast forward to 2024, the same court is revisiting the issue. A lay judge, wearing a headscarf for religious reasons, filed a complaint after being barred from taking her elected office in 2023.
Neutrality vs. religious freedom
The state court argued that religious symbols violate the neutrality requirement. However, the judge argues that wearing a headscarf reflects societal diversity and enhances acceptance of court rulings. The Society for Civil Rights supports this view, believing that excluding groups can undermine trust in the justice system.
When constitutional loyalty is in doubt
The lay judge, also a teacher, faced previous discrimination for her faith. She hopes the Constitutional Court will uphold her civil rights. The court’s decision holds significance for religious freedom and social acceptance in a diverse society.
