The Supreme Court recently reexamined the ruling that declared military trials of civilians illegal, sparking a debate on the scope of intra-court appeals. With a judge questioning whether these appeals should be treated as mere internal reviews or actual appeals, the court delved into the matter in detail.
During the proceedings, Justice Shahid Waheed emphasized the need to clarify the scope of Intra-Court Appeals (ICAs) and settle the court’s powers. The seven-judge bench, led by Justice Amin-ud-Din Khan, discussed the implications of the Oct 23, 2023 verdict, which deemed civilian trials in military courts as illegal.
Furthermore, the court allowed six applications to intervene in the ongoing case, with various bar associations supporting the initial judgement. Concerns were also raised about the treatment of detained individuals and the delay in their trials.
With further proceedings scheduled for July 11, the court continues to navigate this complex legal terrain.
