Challenge to data notice by Dáil, Seanad and Govt officials

The Data Protection Commission’s Enforcement Notice challenging the Dáil, Seanad, and Government officials to provide a citizen access to official documents has sparked a legal battle. Former data protection chief Helen Dixon’s ruling has been contested by eight appellants, including the Ceann Comhairle, Cathaoirleach, and both Clerks of the Dáil and Seanad. The notice, issued just before Dixon left office, demanded compliance within a specified timeframe under threat of penalties.

An Irish citizen’s request for personal data controlled by State entities was denied, leading to the Enforcement Notice. The appellants, including House of Oireachtas officials, argue that the directive violates fair procedures and is rife with errors.

The appeal is set for mediation after being adjourned by Judge John O’Connor. The appellant’s stance against providing access to parliamentary committee documents remains a point of contention.
