The Supreme Court has asked the Uttar Pradesh government to respond to a plea by UP Congress Committee chief Ajai Rai and others to quash criminal proceedings against them under the Gangster Act. The plea was filed after the Allahabad High Court rejected their request.
Rai, who ran against Prime Minister Narendra Modi in the Lok Sabha elections, and others were charged under the Gangsters and Anti-Social Activities Act in 2011. They claim that the Act should not apply to cases initiated by private individuals, and that a compromise agreement should be considered for ending the trial.
The Allahabad High Court dismissed their application in May, stating that there is no legal basis to quash the proceedings. Now, the Supreme Court has issued a notice to the state government and set a date for further consideration on July 15.
