IN-SPACe, the space regulator of India, recently released new guidelines and procedures for space activities, which could impact the country’s growing private space sector. Despite India’s efforts to open up the space sector to private players, the guidelines introduce complexities and uncertainties, leaving key areas such as scientific missions and navigation services unaddressed.
The guidelines also create obstacles for companies looking to provide essential services, such as satellite internet connectivity, to rural areas. Additionally, the process of seeking approvals from multiple ministries even after receiving provisional authorization from IN-SPACe raises concerns about the regulatory environment.
To address these challenges, there is a need for legislation that gives legal authority to IN-SPACe and separates its regulatory and promotional functions. The creation of an IN-SPACe Act along with the establishment of an adjudicatory tribunal can provide clarity and impartiality in regulating the private space sector.
Ultimately, India needs a space regulation Act that is developed through a consultative process involving all stakeholders. Such legislation will pave the way for a flourishing private space sector in India.
