The Intricate Interplay of Juvenile Justice Laws in India: Insights from Chief Justice of India

Chief Justice of India, D Y Chandrachud, recently spoke about the complex nature of juvenile justice in India, highlighting the interplay of various legislative acts that shape the implementation of these laws.

During a National Symposium on Juvenile Justice in Nepal, CJI Chandrachud recounted a recent case where the Supreme Court granted permission to a 14-year-old rape survivor to terminate her 30-week pregnancy. This decision was made under Article 142 of the Constitution, allowing the court to pass orders to ensure complete justice.

While the Medical Termination of Pregnancy (MTP) Act sets a limit of 24 weeks for abortion, exceptions are made for certain vulnerable groups, including minors and rape survivors. The case of the young girl brought to light the importance of considering the mental and physical well-being of juveniles in such situations.

Speaking on the evolution of India’s juvenile justice system, CJI Chandrachud emphasized the need for adequate infrastructure and resources to support juvenile offenders. Limited access to services like counseling and education can hinder the rehabilitation of young individuals, especially in rural areas.

Addressing the unique challenges faced by juveniles with disabilities, the CJI stressed the importance of tailored approaches to ensure the protection and rehabilitation of marginalized groups.
